Terms of Service

1. Agreement to Terms

By accessing or using Swayze (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree with any of these terms, you may not use the Platform. We may update these terms from time to time, and your continued use constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years old to use Swayze. By creating an account, you represent that you meet this age requirement and that all information you provide is accurate and complete.

3. User Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these terms.

4. User Types and Responsibilities

Brands

Brands create and fund campaigns on the Platform. By launching a campaign, you agree to: provide accurate campaign briefs and requirements, fund the campaign budget as specified, and honor the results of the voting process. Campaign budgets are distributed according to the prize structure you set during creation.

Creators

Creators submit original creative work to campaigns. By submitting, you represent that your work is original and does not infringe on any third-party rights. You agree to follow campaign guidelines and grant usage rights to brands for winning submissions as specified in each campaign.

Voters

Voters evaluate and vote on campaign submissions. You agree to provide honest, unbiased votes based on submission quality and campaign criteria. Manipulation of voting results through fake accounts, collusion, or any other means is strictly prohibited and will result in account termination and forfeiture of earnings.

5. Intellectual Property

Creators retain ownership of their submitted content at all times. By submitting work to a campaign, creators grant the brand a license to use winning submissions for commercial purposes as specified in the campaign terms. Non-winning submissions remain fully owned by the creator with no rights transferred.

The Swayze name, logo, and platform design are our intellectual property and may not be used without written permission.

6. Payments and Fees

All payments are processed through Stripe. Campaign budgets are distributed as follows: 90% to winning creators and 10% to voters who voted correctly. Swayze charges a per-creator platform fee on top of the campaign budget, disclosed during campaign creation.

Payouts are processed automatically when campaigns complete. You are responsible for any taxes owed on earnings received through the Platform.

7. Prohibited Activities

You agree not to:

• Submit plagiarized, stolen, or AI-generated content misrepresented as original work
• Manipulate voting through fake accounts, bots, or collusion
• Harass, abuse, or threaten other users
• Use the Platform for any illegal purpose
• Attempt to circumvent the Platform's payment systems
• Create multiple accounts to gain unfair advantage
• Reverse engineer, scrape, or interfere with Platform operations

8. Content Moderation

We reserve the right to remove any content that violates these terms, is inappropriate, or is reported by other users. We may also flag or remove submissions that do not meet campaign requirements. Decisions regarding content moderation are at our sole discretion.

9. Dispute Resolution

If you have a dispute related to a campaign, submission, or payout, please contact us at hello@swayze.io. We will review disputes in good faith and work toward a fair resolution. Our decision on disputes is final.

10. Termination

We may suspend or terminate your account at any time for violations of these terms. You may also delete your account at any time. Upon termination, any pending payouts will be processed according to our standard schedule, provided no terms were violated.

11. Limitation of Liability

Swayze is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms will be resolved in accordance with Section 9.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the Platform at least 30 days before taking effect. Continued use after changes constitutes acceptance.
